The Federal court agreed with the people and stated that the FDA did not have enough evidence to prove the danger if less than 10 mg of ephedra was used so they lifted the ban on ephedra in 2005. The FDA continued to receive reports of death, strokes, and heart attacks so they filed more evidence with the court and got ephedra banned for the second time in 2006.
